Who
- Any citizen entitled to apply for registration by transcription, according to Article 29 of CRCom;
- Any citizen entitled to apply for registration for deposit under the terms of the law.

When
The trade register is compulsory and should be promoted in the following terms:
- Two months from the date on which they were titrated facts about the societies, cooperatives, Joint Ventures (ACE), European Economic Interest Grouping (EEIG), Individual Stores Limited Liability (EIRL);
- Two months from the date of publication of the decree determined the constitution or alteration of public company;
- The application for the benefit of companies and individual establishments with limited liability accounts for registration must be made by the 15th day of the seventh month after the date on which the financial year;
- Registration of actions and injunctions of corporate resolutions suspension must be ordered within two months from the date of its filing.

- Registration for transcription should be carried out within 10 days;

The commercial register is intended to make public the legal status of sole traders, trade organizations, civil societies in a commercial form, cooperatives, among others, with a view to the certainty of transactions.
The commercial register can take two distinct forms - by deposit or transcript:
- Register for Transcription - consists of the account statements of the elements that define the legal status of entities subject to constant registration of the documents. Comprises the registration of entities subject to registration, and the inscriptions, annotations and notes;
- Register for deposit - consists of the mere filing of the documents titered facts subject to registration. It covers the archived documents and the respective indication on the registration form.

- Persons entitled to apply for registration by transcription - Article 29 establishes the following rules of standing to apply for registration:
- The registration beginning, change and cessation of activity of the individual trader, the change of residence and principal place of business, may be required only for himself - paragraph 2 of Article 29 of CRCom;

- In the remaining acts to be registered by deposit, except for shares and other legal measures, only has legitimacy to entity subject to registration, without prejudice to Article 29.º- - paragraph 4 of Article 29 of CRCom.
