New System of Responsible Industry (SIR)

On May 11th, Decree-Law no. 73/2015 was published, which proceeds to the 1st amendment to the Responsible Industry System (CRS) published in annex to Decree-Law no. 169/2012 of 1 August.
Pursuant to article 12 of Decree-Law no. 73/2015 of May 11, the new CRS came into effect on June 1, 2015, providing, as provided in art. 8, the publication of their respective regulatory ordinances within 90 days from the publication of said diploma.
Publication of the ordinances would take place last September.
To know:
  • Ordinance no. 279/2015, of 09/09:
    • It defines the instructional elements of the procedures for the installation, operation and alteration of industrial establishments.
  • Ordinance no. 280/2015, of 09/15:
    • Defines the fees due in procedures for the installation, operation and alteration of industrial establishments in which the central administration or ZER management entities intervene.
  • Ordinance no. 281/2015, of 09/15:
    • Defines the instructional elements of ZER installation, operation, and alteration procedures.
  • Ordinance no. 307/2015, of 09/24:
    • It lays down the rules applicable to compulsory third-party non-contractual liability insurance for Type 1 and Type 2 industrial establishments and entities accredited under CRS.
In view of the date of entry into force of the ordinances, October 6, the conditions for the full application of all the norms contained in Decree-Law no. 73/2015, of May 11, are thus met.
Since the application for industrial licensing must take place through its "Entrepreneur Desk", and given the articulation of this tool with the SILIAMB platform (developed by the Portuguese Agency for the Environment), aiming to guarantee the ordering of applications in environmental regimes and calculation Of the fees to be applied, the "Entrepreneur Desk" will not immediately respond to the new legal framework of industrial licensing.
With this framework, and since the installation and alteration services are unavailable in the "Entrepreneur's Desk", the remission, provided for in the ordinances, will be subject to the provision in paragraph 7 of article 6 of the CRS:
"When, for reasons of temporary unavailability, it is not possible to process the procedures provided for in the CRS through the" Entrepreneur Desk ", it is done by electronic mail, with AMA, IP, to the coordinating entity's electronic address , Advertised on its Internet site and the "Entrepreneur's Desk" access page, or in digital format, and the coordinating entity must ensure compliance with the procedures until the "Entrepreneur Desk" is operational. "
Regarding the use of the BackOffice of the "Entrepreneur Desk" by the entities involved in the licensing processes, it is important to inform that it will remain available and in operation, so that there are no impediments to the processing of the processes in progress.
In addition, it should be noted that, in the exercise of the powers conferred by Decree-Law no. 73/2015, of May 11, IAPMEI made available on October 06 a Portal dedicated to the CRS with a set of online services ( Which are intended only complementary to the "Entrepreneur's Desk").

Finally, in terms of training and qualification, IAPMEI will also ensure, during the course of 2015 (November and December), a Conference Cycle under the new Responsible Industry System.
