This new legislation establishes the principle of freedom of access and exercise of trade activities, services and restaurants, not meeting these activities now subject to any administrative permission that specifically targets the activity in question; a clear example is the opening hours regime establishments covered, which now becomes free and can only be restricted under certain conditions, by local councils.
The previous procedures to control access to and exercise of the activity start to bring up to three types of procedures:
- The presentation of mere previous communications;
- Obtaining permits;
- Obtaining joint authorizations as appropriate.
Administrative procedures regulated by RJACSR are handled in the electronic one-stop shop, called "Entrepreneur Tour".
On protecting the interests of consumers there is the new requirement to provide budget by service providers when the price of services is not pre-determined or there is no such possibility, and when requested by the customer. Another of the significant changes seen at the level of the relevant offenses, which are now classified as minor, serious and very serious, and the values of the respective fines vary according to the size of companies, measured by the number of employees at your service.
